1. Service description

ViglasCard provides digital business profiles, lead capture forms, payment and subscription tools, and related analytics features.

2. Account, eligibility, and security

• You must provide accurate and current information.
• You are responsible for account credentials and all activity under your account.
• We may suspend accounts involved in fraud, abuse, illegal conduct, or security risks.

3. Customer content and acceptable use

• You retain ownership of your content, but grant us the rights needed to host and display it within the service.
• You must not upload illegal, infringing, defamatory, misleading, or harmful content.
• You are solely responsible for claims, offers, products, and services published in your profile(s).

4. Payments, subscriptions, renewals, and cancellation

• Paid plans renew automatically unless canceled before renewal.
• Billing is processed through Stripe and may be subject to Stripe terms and policies.
• If payment fails or the trial expires, features or public visibility may be limited until regularization.
• Except where required by law, fees are non-refundable once the billing period starts.

5. Third-party services

Integrations with third parties (including payment, email, and communication providers) are provided as available. We are not liable for outages, policy changes, or failures originating from third-party systems.

6. Compliance and legal responsibility

• You are responsible for complying with applicable laws in your jurisdiction and industry.
• You must obtain required consents before collecting, storing, or using personal data from leads/customers.
• You agree to defend and indemnify ViglasCard and Viglascode from third-party claims arising from your content, business activity, or legal non-compliance.

7. Disclaimer of warranties

The service is provided "as is" and "as available," without warranties of uninterrupted operation, specific results, merchantability, or fitness for a particular purpose.

8. Limitation of liability

To the maximum extent permitted by law, ViglasCard and Viglascode are not liable for indirect, incidental, consequential, special, punitive, or lost-profit damages. Aggregate liability is limited to amounts paid by you to ViglasCard during the 3 months before the event giving rise to the claim.

9. Governing law and dispute resolution (Miami, Florida)

• These Terms are governed by Florida law, excluding conflict-of-law rules.
• Any dispute shall be resolved in state or federal courts located in Miami-Dade County, Florida, and both parties consent to jurisdiction and venue there.
• To the extent allowed by law, claims must be brought individually and not as class or representative actions.
